If your property is not connected to the public foul sewer network, installing or operating a sewage treatment plant (or replacing an old system) means you must follow UK regulatory requirements. The regulatory framework covers installation standards, discharge limits, maintenance obligations and, in some cases, permitting.

Key Requirements in England & Wales

  • The Environmental Permitting (England and Wales) Regulations 2016 (and equivalent regimes in Scotland, Wales and Northern Ireland) mean that any sewage discharge into ground or surface waters may require an environmental permit.
  • The “General Binding Rules” set minimum standards for small sewage treatment systems and septic tanks. For example:
    • Systems must not discharge untreated sewage into a watercourse.
    • For new or significantly altered discharges (after 2 October 2023) different rules apply.
    • If your discharge exceeds defined thresholds (e.g. volume or to surface water), you must apply for a permit.
  • Installation standards: The units installed must conform to recognised technical standards – for example, the BS EN 12566 suite of standards for small wastewater treatment systems.
  • Maintenance and operator responsibilities: You must ensure the system is emptied, maintained and inspected as required so that it does not cause pollution.

What This Means For You

  • Before installation: Check whether your site requires a permit (if discharge is to surface water or volume is high); ensure you choose a compliant system and get planning/building-regulation advice.
  • After installation: Keep records of servicing and emptying. If you sell the property, you must disclose system type, discharge point and maintenance details.
  • If you don’t comply: The responsible regulator (e.g. Environment Agency in England) can take enforcement action, including prosecution for pollution offences.
